§1 General provisions

Online store Wędliny z Jedliny, available at [www.wedlinyzjedliny.pl], is run by a company WĘDLINY Z JEDLINY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office at ul. Wolska 13, 43-220 Jedlina, Poland, NIP: 6463022917, REGON: 542433825, KRS: 0001188161. Share capital: PLN 5,000. Name of the authority maintaining the register in which the company is entered: DISTRICT COURT KATOWICE-WEST IN KATOWICE, 8th COMMERCIAL DIVISION OF THE NATIONAL COURT REGISTER.

The Regulations set out the rules for the use of the online store, placing orders, performance of sales contracts and complaints, including the rights and obligations of customers.

§2 Definitions

Online store - Internet service available at [www.wedlinyzjedliny.pl], through which the Customer can place an order for Products.

Seller - company WĘDLINY Z JEDLINY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, operating an online store and fulfilling orders.

Customer - natural person, legal entity or organizational unit that places an order in the online store.

Product - goods available in the online store, offered by the Seller for sale, including cold cuts and other food products.

Sales contract - Agreement concluded between the Seller and the Customer at a distance, in which the Seller undertakes to deliver the Product and the Customer undertakes to pay the price.

Electronic Service - services provided by the Seller through the website, such as maintaining a Customer Account, placing orders, etc.
§3 Registering and placing an order

To place an order in the online store, the customer does not need to register. Registration is voluntary and allows for easier ordering in the future.

The order is placed through a form available on the website. The customer is obliged to provide true contact and address data, as well as other information necessary to complete the order.

Once the order is placed, the customer will receive a confirmation of its acceptance at the e-mail address provided.

The seller reserves the right to verify the order, and to refuse to process it if the data provided by the customer is incomplete or false.
§4 Pricing and payment

The prices of the Products listed on the website are gross prices, including VAT.

The customer can pay for the order using one of the available payment methods:

If there is a need for a refund for a payment card transaction, the Seller shall make the refund to the bank account assigned to the Ordering Party's payment card.

The Seller reserves the right to change the prices of the Products, but the price change does not affect orders already placed and confirmed by the Seller.
§5 Order execution

Order processing takes place after payment is credited or, in the case of cash on delivery, after the Seller accepts the order for processing.

The lead time is a maximum of 7 business days from the time the order is accepted.

The Seller may refuse to carry out an order in case of unavailability of the Product or other reasons preventing its realization; in such a situation the Customer will be immediately informed.

In the event that any of the products is unavailable, we will replace it with another similar product at the same or higher price.
§6 Delivery

The ordered goods are delivered to the address specified by the customer.

On the territory of other countries available in the store:

Courier delivery via UPS (the cost depends on the destination country and is calculated individually during checkout).

The delivery cost outside Poland is calculated automatically (from EUR 10 to EUR 150) during checkout and depends on the destination country.

The seller reserves the right to limit deliveries to countries that are available in the order form in the online store.

The seller reserves the right to choose the form of delivery for non-standard shipments or shipments requiring special transport conditions.

The Customer is obliged to check the shipment at the time of receipt. If the shipment is found to be damaged, the Customer should immediately report this fact to the carrier and the Seller.
§7 Right of withdrawal

Due to the nature of the Products (foodstuffs, including cured meats), the Customer does not have the right to withdraw from a distance contract, in accordance with Article 38(4) of the Consumer Rights Act.

The exception is when the Product is defective, in which case the Customer may file a complaint in accordance with the complaint procedure specified in these Regulations.

Entrepreneurs purchasing for business purposes, but not for the buyer's professional nature, do not have the right to withdraw from the contract within 14 days, except if the Product is defective and they can file a complaint in accordance with § X of these Regulations.
- If the shipment is not picked up by the Customer or cannot be delivered for reasons attributable to the Customer (e.g. wrong address, absence, no contact with the courier), the Product is destroyed due to its nature (perishable food) and is not subject to reuse or refund. The Seller shall then consider the contract executed in full and shall not be responsible for the Customer's failure to collect the shipment.
§8 Complaints

The customer has the right to file complaints about the purchased Products if they are not in accordance with the contract or defective.

Complaints may be submitted by email to: kontakt@wedlinyzjedliny.pl or by mail to the address of the Seller's headquarters (Wolska 13 Street, 43-220 Jedlina,).

The complaint should include:
- Customer's name or company name,
- Contact details (address, email address, phone number)
- order number,
- date of purchase of the Product,
- A description of the abnormality or defect in the Product,
- Photos of the Product subject to the complaint showing the reported defect
- Customer's request in connection with a complaint.
- The Client has the right to submit complaints concerning purchased Products if they are not in conformity with the contract or are defective.

The Seller will consider the complaint within 14 days from the date of its receipt and will inform the Customer of the result of the proceedings in the form in which the complaint was submitted.

If the complaint is accepted, the Seller:
- will replace the Product with a new one,
- will remove the defect,
- will return to the Customer the equivalent of the price of the Product, depending on the situation and the Customer's choice.
- The provisions of this paragraph shall apply both to consumers and to sole proprietors who purchase Products for non-business purposes.
§9. personal data protection

The administrator of the Customers' personal data is the Seller.

Personal data is processed for the purpose of processing the order, contacting the customer and in accordance with applicable laws.

The customer has the right to inspect his data, correct it or request its deletion if the purpose of processing ceases.
§10 Final provisions

Agreements concluded through the online store Wędliny z Jedliny are concluded in accordance with Polish law.

In the event of changes to these Terms and Conditions, the Seller will inform customers by publication on the store's website; changes do not affect orders placed before their implementation.

Any disputes will be settled by a common court of competent jurisdiction over the Seller's registered office.

The regulations are effective as of 28.03.2025.
§11 Information on the origin of products
- All products offered in the store come from a proven manufacturer that meets the sanitary and veterinary requirements of Poland and the European Union.
- The sausages on offer come from the manufacturer: Zakłady Mięsne Boroń Sp. z o.o., 13 Wolska St., 43-220 Jedlina.
- Weronika Boroń, owner of Wędliny z Jedliny Weronika Boroń, acts as the distributor and seller of finished products and is not their manufacturer.
- Detailed information about the manufacturer and composition of each product can be found in the description of the product on the store's website.
§12. Sales Documentation (E-Receipts)
- The Seller issues and provides proof of purchase in electronic form (e-receipt).
- By making a purchase in the Store and accepting these Terms and Conditions, the Customer consents to receiving the e-receipt in the form of a digital file.
- The e-receipt is sent to the email address provided by the Customer in the order form immediately after the sale is completed.
§13. Product Reviews
- Customers of the Store may voluntarily submit reviews of the Products they have purchased.
- Reviews published in the Store are provided exclusively by Customers who have purchased the relevant Product from the online store.
- Reviews are verified by checking whether the person submitting the review has purchased the Product from the Store, in particular by linking the review to the Customer’s order history.
- The Seller moderates reviews before they are published. Moderation consists of checking whether the reviews comply with applicable laws and these Terms and Conditions.
- The Seller may refuse to publish a review or remove a review, in particular where:
a) it contains vulgar, offensive content or content that infringes the personal rights of third parties,
b) it contains personal data or sensitive information,
c) the review was submitted by a person who did not purchase the relevant Product from the Store (verification is carried out by matching the email address of the person submitting the review with the order details in the Store’s system),
d) it is of an advertising, spam, or promotional nature. - Review moderation does not involve selecting reviews based on whether they are positive or negative. Both positive and negative reviews may be published.
§14. Customer Account
- The Customer may create a Customer Account in the online store by registering.
- Registration of a Customer Account is voluntary and free of charge.
- To create a Customer Account, the Customer must provide an email address and set a password.
- The Customer Account enables the Customer, in particular, to:
a) placing orders without having to provide their details each time,
b) accessing their order history,
c) managing the Customer’s personal data. - The Customer is required to provide accurate information when registering and must not share their login credentials with third parties.
- The Customer may delete their Customer Account at any time by contacting the Seller or using the functionalities available within the Customer Account.
- he Seller may delete the Customer Account if the Customer breaches these Terms and Conditions or applicable laws.
